Infinite Breath Terms of Use
Welcome to Infinite Breath, a breathwork and meditation app developed by Dylan Drendel ("Company", "we", or "us"). By downloading, accessing, or using the Infinite Breath app (the "App"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these Terms of Use or the Privacy Policy, please do not use the App.
Use of the App
The App is licensed, not sold, to you for use only under these Terms of Use. We reserve all rights not expressly granted to you. Subject to these Terms of Use, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use a copy of the App on a mobile device that you own or control, solely for your personal, non-commercial use.
Registration and Accounts
To access certain features of the App, you may be required to create an account by providing certain information and/or by using a third-party account such as Google or Apple ("Third-Party Account"). You agree to provide accurate, current, and complete information during the registration process, and to update your account information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Account Deletion
If you would like to delete your account, please contact us at infinitebreathapp@gmail.com and let us know your name and email address that you signed up with.
We will delete your account and all associated data within 30 days of receiving your request. This includes all session data and profile data.
Content and License
The App may contain content, including but not limited to text, images, and other materials ("Content"). We grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and view the Content solely in connection with your permitted use of the App and solely for your personal and non-commercial purposes.
Third-Party Services and Content
The App may integrate with or provide links to third-party services, websites, products, or content ("Third-Party Services"). Your use of Third-Party Services is at your own risk and subject to the terms and conditions of those Third-Party Services. We do not endorse or accept any responsibility for Third-Party Services.
User Content
The App may allow you to upload, submit, or transmit content, including text, images, and other materials ("User Content"). You retain ownership of your User Content, but by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the App and our business.
Analytics and Advertising
The App uses Google Analytics to collect information about your use of the App. We may also use advertising services to deliver relevant advertisements to you. By using the App, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.
Modifications and Termination
We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time, with or without notice. We may also terminate or suspend your access to the App at any time, without notice, for any reason or no reason.
Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
Limitation of Liability
In no event shall we be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from your use or inability to use the App.
Governing Law and Dispute Resolution
These Terms of Use shall be governed by and construed in accordance with the laws of the United States of America. Any dispute arising out of or relating to these Terms of Use shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
Miscellaneous
These Terms of Use constitute the entire agreement between you and us regarding your use of the App and supersede all prior or contemporaneous communications and proposals, whether oral or written. If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
